Protection for a Qualifying Self-Defense Case

The current AOR agreements describe substantial legal services and related benefits when a matter meets the program's requirements.

Criminal and Civil Defense Legal representation for qualifying criminal matters and related civil defense, subject to the governing agreements and policy.
Legal Fees Through Trial The membership agreement states that legal fees for qualifying criminal and related civil cases are covered through trial without a stated financial limit on those legal fees.
Expert Witnesses & Investigators Necessary experts, investigators and covered court-related expenses may be provided for qualifying matters.
Appeals Necessary good-faith appellate legal representation is included for covered self-defense-related legal matters.
Felony Trial Team The current AFF Legal Services Agreement states that AFF provides four lawyers in the courtroom for a felony trial involving a covered self-defense-related legal matter.

Victim Representation Legal representation may also be available when the member is the victim and another person is criminally charged from the same qualifying self-defense incident.
Expungement / Record Relief Where legally available, the agreement provides up to $5,000 toward legal fees to set aside or expunge a covered incident.
Psychological Counseling The current membership agreement provides up to $1,500 for psychological counseling following a qualifying matter.
Scene Cleanup Up to $4,000 is available for qualifying cleanup of a member's home or vehicle.
Firearm Reimbursement The current agreement provides up to $1,000 toward firearm reimbursement when applicable.
Defense-Related Costs The AFF agreement identifies potentially covered expenses such as investigators, experts, scientific testing, court costs, transcripts, records and other expenses necessary for effective representation.

Conditions AOR Says Do Not Automatically Operate as Exclusions

When a matter otherwise satisfies the requirements for a covered self-defense-related legal matter, the current agreements state that several circumstances do not, by themselves, automatically prevent representation.

  • Imperfect self-defense or conduct later determined to be criminal.
  • Negligent, accidental or unintentional discharge during the act of self-defense.
  • Alcohol or drug impairment.
  • Use of an illegal weapon.
  • No weapon or use of something other than a firearm.
  • An incident occurring where firearms were legally prohibited.
  • A domestic relationship involving the other person.
  • No concealed-carry permit or an expired permit.
  • Prohibited-possessor status.
  • Force that was not deadly physical force.

When Does the Self-Defense Protection Apply?

The current AOR documents identify three basic requirements for a self-defense-related legal matter.

Criminal charge or reasonable concern about being charged. The member must be charged, or reasonably concerned about being charged, with a state or federal criminal offense.
The incident must occur after membership becomes active. The conduct giving rise to the actual or potential charge must occur entirely after the member becomes an active AOR member.
Self-defense or defense of another must be asserted in good faith. The facts must support a good-faith assertion of self-defense or defense of a third party as a legally sufficient complete defense.
